Terms of Service

Hamdam is a reflection companion grounded in Persian poetic wisdom. These Terms cover your licence to use the app, the Hamdam Plus subscription, and how your journal content is treated.

It's worth the eight minutes, especially Section 4. Hamdam offers gentle reflection, not medical or mental health advice, and that distinction matters for how you use it.

Hamdam is made by Seyed Valiallah Azizollahi, also known as Ealia Azizollahi. Both names refer to the same person, and both appear in these Terms and in the Privacy Policy.

1. Acceptance

By downloading, installing, or using Hamdam, you agree to these Terms. If you don't agree, don't use Hamdam.

2. License

Hamdam grants you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, obtained through the App Store. This licence doesn't extend to commercial use or redistribution of the app or its content.

3. Hamdam Plus Subscription

The free tier includes fifteen reflections every calendar month, a fourteen day window on your reflection archive and insights, daily verses drawn from all five poets, and the full library of 235 bundled verses. Hamdam Plus currently includes:

  1. Unlimited reflections, with no monthly limit.
  2. Your full reflection archive, beyond the fourteen day free window.
  3. Insights calculated across your whole history rather than the last fourteen days.
  4. iCloud synchronisation between your own devices.
  5. Health body signals, covering sleep and activity.
  6. New verses and reflections added each week.
  7. Deep Mode, for longer and more searching reflection prompts.
  8. Sharing reflections to Apple Journal.
  9. Poet deep-dives for Saadi, Khayyam and Parvin Etesami: their biography and cultural context pages, not their poetry. The verses themselves are free, from all five poets. The Hafez and Rumi deep-dives are free as well.
  10. Cultural moment detail in the Roots section.
  11. Apple Music playback alongside your reflection, which is also available if you have your own Apple Music subscription.

Hamdam Plus is available as a monthly or yearly subscription, or as a single one-time Lifetime purchase.

3.1 Pricing

Pricing is set and displayed by Apple at the point of purchase. Current pricing is available on the App Store and is subject to change by Apple.

3.2 Free trial

Monthly and Yearly subscriptions include a 7-day free trial for new subscribers. The trial converts to a paid subscription unless cancelled before it ends. See Section 3.5 for cancellation instructions.

3.3 Family Sharing

The Lifetime plan supports Family Sharing, for up to six members through Apple's Family Sharing. Monthly and Yearly plans are single-user.

3.4 Auto-renewal

Monthly and Yearly plans auto-renew unless cancelled, at the then-current price, charged to your Apple ID. Manage or cancel renewal through your Apple ID subscription settings.

3.5 Cancellation

Cancel anytime via Settings → your Apple ID → Subscriptions on your device. Cancelling stops the next renewal; you keep access until the end of the current billing period. There's no refund for the unused portion of a current period, subject to Apple's own refund policy.

3.6 Price changes

Apple may adjust pricing. You'll be notified in advance via the App Store, per Apple's standard process. Continuing your subscription after that notification means you accept the change.

4. Health and Wellness Disclaimers

4.1 Not medical advice

Hamdam is a reflection companion, not medical, mental health, or wellness advice. Nothing in Hamdam substitutes for professional healthcare, mental health support, medical diagnosis, or treatment.

4.2 Consult professionals

For medical questions, physical or mental health concerns, or health decisions, consult a qualified healthcare provider.

4.3 Mental health crisis

If you or someone you know is in crisis or needs immediate mental health support:

  • Australia: Lifeline, 13 11 14 (24/7)
  • Australia emergency: 000
  • International: contact your local crisis line or emergency services

Hamdam is not a substitute for crisis support.

4.4 Body observations

Hamdam offers gentle observations about body signals: sleep, activity, cycle. These are contextual observations, not medical assessments or diagnoses.

4.5 Fitness features

Fitness observations are contextual only. Consult your doctor before starting an exercise routine, changing your physical activity, or acting on any fitness observation.

4.6 Cycle awareness

Cycle observations use your logged menstrual data only. They are not a substitute for medical cycle tracking, pregnancy prevention, pregnancy planning, or medical consultation.

4.7 Reflection content

Reflections and observations are contemplative in nature. They are not therapy, counselling, or spiritual guidance for medical use.

5. Cultural Content Attribution

5.1 Persian poetry sources

Verses from Hafez, Rumi, Saadi, Khayyam, and Parvin Etesami are in the public domain, sourced from the Ganjoor.net archive with attribution. Hamdam's curation and English translations, along with its cultural context and reflections, are © Ealia Azizollahi.

5.2 Your rights to Hamdam content

Content is for your personal use within the app only. No commercial redistribution, and no republishing without permission.

5.3 Cultural sensitivity

Persian poetry references wine, love, and mystical imagery as literary and spiritual metaphor. These are historical Persian literary conventions, not endorsements of substance use.

6. User Content

6.1 Journal entries

You own your journal entries. Hamdam holds no licence to your journal content, and you can delete any entry at any time. Your journal syncs only through your own iCloud account.

6.2 No sharing

Hamdam does not share your journal content with anyone. There's no public feed and no social features.

7. Prohibited Uses

  • Reverse engineering the app
  • Redistributing app content
  • Commercial use of the app or its content
  • Using Hamdam to harm yourself or others
  • Using Hamdam in violation of applicable law

8. Termination

You can stop using Hamdam anytime by uninstalling it. Hamdam may terminate your access for violating these Terms. For subscription cancellation, see Section 3.5.

9. Warranty Disclaimers

9.1 As-is

Hamdam is provided “as is” without warranties of any kind, except where non-excludable guarantees under Australian Consumer Law apply.

9.2 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any non-excludable right under Australian Consumer Law. Where the ACL implies a condition, warranty, or guarantee, our liability for breach is limited to the extent the law permits.

10. Limitation of Liability

10.1 Standard limitations

To the maximum extent the law permits, Hamdam is not liable for indirect, incidental, special, or consequential damages.

10.2 Non-excludable rights

Where the ACL grants a non-excludable right, that right applies and this limitation does not restrict it.

10.3 Health-related limitations

Hamdam is not liable for decisions made based on reflections, observations, or content in the app. Health decisions are yours, made in consultation with qualified professionals.

11. Indemnification

You agree to indemnify Hamdam for claims arising from your misuse of the app or violation of these Terms, to the extent the law permits.

12. Third-Party Services

Hamdam uses Apple's HealthKit, EventKit, WeatherKit, iCloud, StoreKit, MusicKit (Apple Music), and Foundation Models frameworks, and the Apple public iTunes Search API. Apple's own terms and privacy policies apply to those services.

Hamdam also reads reference content from the Wikipedia REST API (en.wikipedia.org) and upload.wikimedia.org; resolves cultural symbol photographs and their licences through www.wikidata.org and commons.wikimedia.org; falls back to iNaturalist (api.inaturalist.org, with images served from inaturalist-open-data.s3.amazonaws.com) when Wikimedia holds nothing it may use; and reads public holiday dates from Nager.Date (date.nager.at). Those are the services Hamdam contacts that are not operated by Apple, and there are no others. Each is independent, and its own terms apply to it. What each one receives is set out in Section 5 of the Privacy Policy.

13. Changes to These Terms

If these Terms change materially, you'll be notified through an app update. Continuing to use Hamdam after a change means you accept the update. The effective date at the top of this page always reflects the current version.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia. Australian Consumer Law applies where relevant. Disputes are subject to the jurisdiction of Queensland courts, unless the ACL provides otherwise.

15. Intellectual Property

The HAMDAM™ name, trade mark, and the Hamdam app (including the iOS app, watchOS app, and any related services), content (including curated Persian poetry selections, reflection prompts, and cultural moment content), and all associated intellectual property are owned by Seyed Valiallah Azizollahi.

HAMDAM™ is the subject of a pending Australian trade mark application (no. 2674427, filed 11 July 2026, Classes 9 and 42) with IP Australia.

You may not use the HAMDAM name, trade mark, or any associated intellectual property without prior written permission from the owner.

Persian poetry featured within the application is sourced from public domain works by classical Persian poets (Hafez, Rumi, Saadi, Khayyam, and Parvin Etesami). Original Persian text is sourced from Ganjoor.net. Reflections, curation, and English translations (where applicable) are the original work of the Hamdam team.
